This one goes beyond rumor.

It is a fact that the HOA has posted the law suit 'OPT OUT' form on their bulletin board. They have attributed authorship of the form to a director and officer of the Tropical Isles Co-op, Inc., Joyce Terlin0.

The statement by the HOA that the 'OPT OUT' form was written by Joyce Terlino or anyone else on the Co-op Board is without any basis in fact and is TOTALLY FALSE.

The Truth:
The 'OPT OUT' form, when properly signed and filed, is a legally binding document prepared by the Co-op’s legal counsel. The Co-op’s directors authorized preparation of the form at the request of some Homeowners. These Homeowners clearly stated their desire to be excluded from the class of Homeowners who are suing the Co-op. These Homeowners desire to insulate themselves from the potential costs, fees and liabilities that might be associated with this litigation.

Every Homeowner should give careful consideration to their position on this issue.
